These Terms of Service (the "Agreement") are a binding agreement between Hostalika, LTD ("Hostalika", "us", or "our") and you ("User", "you", or "your"). This Agreement sets forth the general terms and conditions of your use of the products and services made available by Hostalika and of the Hostalika.com website (collectively, the "Services"). By using the Services, you agree to be bound by this Agreement. If you do not agree to abide by the terms of this Agreement, you are not authorized to use or access the Services.
PLEASE READ THIS AGREEMENT CAREFULLY. IT CONTAINS ARBITRATION AND CLASS ACTION WAIVER PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.
1. Account Eligibility
By registering for or using the Services, you represent and warrant that:
You are eighteen (18) years of age or older. The Services are intended solely for Users who are eighteen (18) years of age or older. Any registration, use of, or access to the Services by anyone under eighteen (18) is unauthorized and constitutes a violation of this Agreement.
If you use the Services on behalf of a legal entity or another party, you represent that you are authorized to bind such entity to this Agreement and to act on its behalf.
You will provide accurate, current, truthful, and complete information upon registration, including an email address that differs from the domain you are signing up under. You are solely responsible for maintaining the accuracy of your account contact information at all times. Hostalika is not responsible for any lapse in Services resulting from outdated contact information.
You are fully responsible for all activity conducted under your account and for maintaining the confidentiality of your password and account credentials.
Dedicated IP address requests beyond those included with a hosting package may be subject to IP justification requirements consistent with the policies of the American Registry for Internet Numbers (ARIN) or RIPE NCC. Hostalika reserves the right to deny any dedicated IP request based on insufficient justification or current IP utilization.
2. Transfers
Our Transfers Team will make every effort to assist you in migrating your website to Hostalika. Transfers are provided as a courtesy service for up to ten (10) cPanel accounts. Additional migrations are available at our standard hourly administrative rate. We must be able to obtain a full cPanel backup from your current host, and the compressed account size must not exceed 1 GB. Hostalika reserves the right to modify or discontinue the transfer policy at any time.
We make no guarantees regarding the availability, feasibility, or time required to complete an account transfer. Some hosting platforms save data in incompatible or proprietary formats, which may make migration of some or all account data difficult or impossible. The free transfer service is available for thirty (30) days from your sign-up date. Transfers requested outside this period may be subject to additional charges.
In no event shall Hostalika be liable for any lost or missing data resulting from a transfer to or from Hostalika. You are solely responsible for backing up your data in all circumstances.
3. Hostalika Content
Except for User Content (as defined below), all content available through the Services - including designs, text, graphics, images, video, information, software, audio and other files, and their selection and arrangement (collectively, "Hostalika Content") - is the proprietary property of Hostalika or its licensors. Hostalika Content may not be modified, copied, distributed, reproduced, republished, displayed, posted, transmitted, sold, or exploited for any purpose in any form or by any means, in whole or in part, other than as expressly permitted in this Agreement. You may not, directly or indirectly, reverse engineer, decompile, disassemble, or otherwise attempt to derive source code or trade secrets from any Hostalika Content.
4. User Content
You may upload, store, publish, display, and distribute information, text, photos, videos, and other content on or through the Services (collectively, "User Content"). You are solely responsible for any and all User Content and any transactions or activities conducted on or through your hosted websites. By posting or distributing User Content, you represent and warrant that (i) you hold all necessary rights to do so, and (ii) such posting does not infringe or violate the rights of any third party.
You may not use your /home/ directory to store backups, including backups generated by cPanel, WHM, or any third-party application. Automated nightly backups of websites are performed to off-site locations. If you wish to maintain your own backups, you must purchase dedicated block storage from Hostalika at the rates listed on our pricing page. Hostalika reserves the right to remove any files that violate this policy. Accounts found in violation are subject to immediate suspension or termination.
Solely for the purpose of providing the Services, you grant Hostalika a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute User Content, and to create archival or backup copies thereof. Hostalika does not acquire any ownership interest in User Content.
Hostalika does not monitor User Content but reserves the right to take corrective action in its sole discretion, including removal of content or suspension or termination of Services without refund, if you violate this Agreement.
5. Prohibited Persons, Countries, and Territories
Hostalika complies with all applicable international sanctions regulations, including those administered by the Office of Foreign Assets Control (OFAC) of the U.S. Department of the Treasury. The Services are expressly prohibited to individuals, entities, and organizations located in, operating from, or ordinarily resident in the following sanctioned countries and regions:
Syria (Syrian Arab Republic)
Iran (Islamic Republic of Iran)
Cuba (Republic of Cuba)
North Korea (Democratic People's Republic of Korea)
Crimea (Ukrainian territory under occupation)
Donetsk (Ukrainian territory under occupation)
Luhansk (Ukrainian territory under occupation)
This prohibition extends to any individual listed on the Specially Designated Nationals (SDN) list maintained by OFAC, or on any other applicable international sanctions list. If you are located in any of the above territories or appear on any such list, you are strictly prohibited from registering, subscribing to, or using the Services in any capacity.
Hostalika will not register Country-Code Top Level Domain names (ccTLDs) associated with any of the sanctioned countries listed above without explicit written authorization. Violation of this section constitutes a material breach of this Agreement and will result in immediate account termination without refund.
6. Account Security and Hostalika Systems
You are solely responsible for ensuring that all scripts and programs installed under your account are secure and that directory permissions are configured appropriately, regardless of the installation method. Where possible, directory permissions should be set to 755 or more restrictive. You are ultimately responsible for all actions taken under your account, including any compromise of account credentials.
You are required to use a strong password at all times. Accounts found using weak passwords may be suspended until a more secure password is adopted. Hostalika may, at its discretion, conduct periodic password audits and will notify you before taking any suspension action.
Hostalika may, but is not obligated to, monitor its systems to ensure authorized use, facilitate protection against unauthorized access, and verify security procedures. By using the Services, you consent to such monitoring. Any account found connecting to a third-party network or system without express written authorization from that third party is subject to suspension. Hostalika reserves the right to migrate your account between data centers without prior notice for operational, compliance, or technical reasons.
7. Acceptable Use Policy (AUP)
All use of Hostalika's Services is subject to the Acceptable Use Policy published on our website. The AUP sets out in detail the permitted and prohibited uses of the Services. Key restrictions include, but are not limited to:
Sending unsolicited bulk email (spam) or any form of unsolicited commercial messaging.
Hosting or distributing illegal, harmful, abusive, or defamatory content, or content that infringes any third-party intellectual property rights.
Running scripts or programs that consume excessive server resources.
Engaging in any activity that compromises the security or stability of the network.
Hosting, distributing, or executing malware, exploit tools, or unauthorized network scanning utilities.
Please review the full Acceptable Use Policy on our website for a comprehensive list of prohibited activities. Violations of the AUP will result in immediate termination of Services.
8. Abuse Handling and DMCA
8.1 Abuse Reporting
Hostalika takes abuse reports seriously and cooperates fully with infrastructure partners including Hetzner, OVH, and others to address violations. We reserve the right to suspend or terminate any account found to be engaged in abusive activity, including but not limited to malicious scanning, spam distribution, or malware hosting. 8.2 DMCA Notices
Hostalika respects intellectual property rights and responds promptly to valid DMCA takedown notices. If you believe that content hosted on our infrastructure infringes your intellectual property rights, please submit a written notice to legal@hostalika.com that includes:
Identification of the copyrighted work claimed to have been infringed.
Identification of the infringing material and its location on our network.
Your full contact information.
A statement of your good-faith belief that the use is not authorized.
A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.
9. DDoS Mitigation and Null Routing Policy
Hostalika employs industry-standard measures to protect its infrastructure against Distributed Denial of Service (DDoS) attacks. In the event that any account or IP address becomes the target of a DDoS attack of sufficient magnitude to threaten network stability, Hostalika reserves the right to:
Apply temporary null routing to the targeted IP address to protect the broader network and other customers.
Suspend affected services until the attack subsides.
Document the incident and notify the affected customer.
Hostalika bears no liability for service interruptions resulting from DDoS attacks outside its reasonable control. Accounts that are repeatedly targeted by DDoS attacks requiring extraordinary engineering intervention may be subject to additional fees or termination at Hostalika's sole discretion.
10. Data Protection and GDPR
Hostalika acknowledges the importance of data protection and is committed to its principles. If you serve customers located in the European Economic Area (EEA) or any jurisdiction with equivalent data protection legislation, you are solely responsible for:
Ensuring your own compliance with the General Data Protection Regulation (GDPR) or any applicable local data protection laws.
Obtaining all necessary consents from your end users for the collection and processing of their personal data.
Maintaining a clear and accessible privacy policy on your website.
Hostalika acts as a data processor in respect of the technical infrastructure it provides. You, as the customer, are the data controller. Hostalika is not responsible for your compliance with any legal obligations relating to your end users' personal data. 11. HIPAA Disclaimer
Hostalika is not HIPAA compliant. You are solely responsible for any applicable compliance with federal or state laws governing the privacy and security of personal data, including medical or other sensitive information. The Services are not appropriate for the storage or processing of "protected health information" as defined under HIPAA. Storing or permitting access to protected health information using the Services constitutes a material breach of this Agreement and grounds for immediate account termination. Hostalika does not execute Business Associate Agreements.
12. Billing and Payment
12.1 Multiple Accounts
Users may not open multiple accounts to exploit new-customer discounts or promotions. Accounts found in violation of this policy will be suspended until all outstanding invoices are settled. Repeated abuse of the discount system may result in account termination without refund.
12.2 Prepayment
You are responsible for ensuring that your payment information is current and that all invoices are paid on time. You agree to pay for the Services in advance of the period during which they are provided. Payments received will be applied first to the oldest outstanding invoice on your account.
12.3 Autorenewal
Unless you notify Hostalika of your desire to cancel, Services will be billed on an automatically recurring basis using the payment method on file, to prevent any disruption to your Services.
12.4 Taxes
Listed fees do not include any applicable sales, use, revenue, excise, or other taxes imposed by any taxing authority. Any applicable taxes will be added to your invoice as a separate line item and are your responsibility to pay.
12.5 Late Payment
All invoices must be paid within seven (7) days of the invoice due date. Any invoice outstanding beyond seven (7) days may result in the suspension or termination of Services. Access to your account will not be restored until payment is received in full. Hostalika will not activate new orders for customers with outstanding balances.
12.6 Invoice Disputes
You have ninety (90) days to dispute any charge processed by Hostalika. Please contact our billing department directly for assistance with any invoice inquiries.
13. VPS Services Policy
Virtual Private Server (VPS) services are subject to the following terms in addition to the general provisions of this Agreement:
VPS accounts are not included in Hostalika's automated backup service. You are solely responsible for maintaining your own backups.
Manually installing modules or bypassing WHM/cPanel in a managed VPS environment may void your managed service coverage.
Server resources (CPU, RAM, bandwidth) are allocated in accordance with the specifications of the plan purchased.
Hostalika reserves the right to reclaim any IP addresses assigned to your VPS upon termination or expiration of the service.
Excessive resource consumption may result in temporary suspension of the VPS until an appropriate resolution is agreed upon.
14. Uptime Guarantee
If your shared server experiences physical downtime that falls below the 99.9% uptime guarantee, you may request a credit to your account at Hostalika's discretion. This guarantee does not apply to scheduled maintenance windows. Server uptime is measured based on operating system and Apache Web Server reporting and may differ from third-party monitoring service reports. Uptime guarantees apply to shared and reseller hosting solutions only.
15. Cancellations and Refunds
15.1 Thirty-Day Money-Back Guarantee
Hostalika offers a thirty (30) day money-back guarantee for hosting services only. If you cancel your account within thirty (30) days of signing up, you may request a refund of basic hosting fees paid, minus any applicable setup fees. This guarantee does not apply to:
Domain registrations, VPS services, or dedicated servers.
Administrative fees, installation fees, or custom software setup fees.
Any additional or ancillary service fees.
15.2 Refund Eligibility
Refunds under the money-back guarantee are available to first-time accounts only. If you have previously held an account with Hostalika, cancelled it, and subsequently re-subscribed, or if you hold more than one account with us simultaneously, you are not eligible for a refund. Violation of this Agreement constitutes a waiver of any refund rights.
15.3 Non-Refundable Products and Services
There are no refunds on domain registrations, dedicated servers, administrative fees, or license and installation fees. All domain registrations and renewals are final and non-refundable.
15.4 Payment Method Restrictions
No cash refunds will be issued for payments made via bank wire transfer, Western Union, checks, or money orders. Any applicable credit for such payments will be applied to your hosting account balance.
15.5 Cancellation Process
To cancel your Services, you must submit a written cancellation request via the cancellation form provided on our website. Upon receipt and verification of your request, Hostalika will confirm the cancellation in writing. Cancellations of shared hosting accounts take effect on the account's next renewal date. You remain obligated to pay all fees accrued up to the effective date of cancellation.
15.6 Domain Renewals
Domain renewals are processed thirty (30) days before the renewal date. To cancel a domain registration, you must notify Hostalika's Billing department via a support ticket at least thirty (30) days prior to the renewal date. No refunds will be issued once a domain has been renewed.
16. Termination
Hostalika may terminate your access to the Services, in whole or in part, without prior notice in the event that: (i) you fail to pay any fees due; (ii) you violate this Agreement; (iii) your conduct may harm Hostalika or others, as determined by Hostalika in its sole discretion; or (iv) as otherwise specified in this Agreement. In such event, Hostalika shall not refund any prepaid fees, and you remain obligated to pay all charges accrued prior to termination.
UPON TERMINATION OF THE SERVICES FOR ANY REASON, ALL USER CONTENT, USER WEBSITES, AND ASSOCIATED DATA WILL BE PERMANENTLY DELETED.
17. CPU, Bandwidth, and Disk Usage
All use of hosting space is subject to this Agreement and the Acceptable Use Policy. Shared hosting space may only be used for web files, active email accounts, and User Website content. Shared hosting space may not be used for general file storage, off-site backups, FTP hosting, or any purpose unrelated to active website operation. Hostalika reserves the right to review any shared account for excessive resource usage and may, at its discretion, terminate access, apply additional fees, or remove content found to be in violation.
Shared servers are not subject to a fixed bandwidth limit.
18. Price Changes
Hostalika reserves the right to modify pricing, monthly payment amounts, or any other fees at any time. We will provide at least thirty (30) days' notice before implementing any price change. It is your responsibility to review billing communications from Hostalika on a regular basis.
19. Coupons and Discounts
Discount codes and promotional coupons are reserved for first-time accounts and first-time customers only, and may not be applied toward domain registrations unless otherwise specified. Any account found to be abusing the discount system will be subject to review and may be suspended or terminated without refund. All coupons and discounts apply to the initial purchase only and do not affect renewal or recurring pricing.
20. Limitation of Liability
IN NO EVENT WILL HOSTALIKA, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF THE SERVICES, EVEN IF HOSTALIKA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
HOSTALIKA'S TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, IS LIMITED TO THE AMOUNT PAID BY YOU TO HOSTALIKA FOR THE SERVICES DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE INITIAL ACTION GIVING RISE TO LIABILITY. THIS IS AN AGGREGATE LIMIT.
21. Indemnification
You agree to indemnify, defend, and hold harmless Hostalika, its affiliates, and their respective officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, suits, actions, demands, proceedings, and expenses (including reasonable attorneys' fees) arising out of or relating to: (i) your use of the Services; (ii) any breach or violation of this Agreement by you; or (iii) any act or omission by you. The obligations under this section survive termination of this Agreement.
22. Arbitration
By using the Services, you agree to submit any dispute relating to, concerning, or arising out of this Agreement to binding arbitration administered by the American Arbitration Association (AAA) in accordance with its applicable Consumer Rules. Arbitration will be conducted before a single arbitrator selected pursuant to AAA Rules and will take place in Kansas City, Missouri. The arbitrator's award is final and binding and may be entered as a judgment in any court of competent jurisdiction.
Claims may not be joined or consolidated without the written consent of all parties. If you demonstrate that the costs of arbitration would be prohibitive compared to litigation, Hostalika will pay such portion of the filing, administrative, and arbitrator fees as the arbitrator deems necessary to prevent arbitration from being cost-prohibitive. The Federal Arbitration Act governs all arbitration under this section.
22.1 Opt-Out
You may opt out of this arbitration provision by notifying Hostalika in writing within thirty (30) days of the date on which you entered into this Agreement or purchased a subscription, whichever is earlier. Your written opt-out notice must be sent to:

Your notice must include your name, address, account information, and a clear statement that you do not wish to resolve disputes through arbitration. Where you opt out, all disputes shall be heard exclusively in a court of competent jurisdiction located in Kansas City, Missouri.
23. Class Action Waiver
You and Hostalika agree that any proceedings to resolve or litigate any dispute, whether through a court of law or arbitration, shall be conducted solely on an individual basis. You waive any right to bring or participate in any class action, representative action, collective action, or private attorney general action. You also waive the right to trial by jury in any dispute with Hostalika.
24. Governing Law and Jurisdiction
This Agreement is governed by the laws of the State of Missouri, without regard to its conflict of law principles. Any dispute not subject to arbitration shall be brought exclusively before a court of competent jurisdiction located in Kansas City, Missouri. You agree that any claim or cause of action arising out of or related to the Services or this Agreement must be filed within one (1) year after such claim or cause of action arose, or it shall be forever barred.
25. Disclaimer
Hostalika shall not be responsible for any damages your business may suffer. Hostalika makes no warranties of any kind, express or implied, with respect to the Services and expressly disclaims any implied warranty of merchantability or fitness for a particular purpose, including loss of data resulting from delays, delivery failures, wrong deliveries, or any and all service interruptions.
26. Backups and Data Loss
Your use of the Services is at your sole risk. Hostalika's backup service runs once per night and overwrites the previous backup. Only one night of backups is retained at any given time. This service is provided as a courtesy for shared and reseller accounts only and may be modified or discontinued at any time at Hostalika's sole discretion.
Important: Accounts exceeding 20 GB of disk usage or 100,000 inodes will not be included in nightly backups. VPS accounts are not covered by any automated backup service.
Hostalika is not responsible for any files or data stored on your account. You agree to take full responsibility for all data transferred to or stored on Hostalika's servers and to maintain all appropriate backup copies.
27. Limited Warranty
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. HOSTALIKA AND ITS AFFILIATES, EMPLOYEES, AGENTS, SUPPLIERS, AND LICENSORS DISCLAIM ALL WARRANTIES OF ANY KIND, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. HOSTALIKA MAKES NO REPRESENTATION OR WARRANTY THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE, OR AS TO THE ACCURACY, RELIABILITY, OR CONTENT OF ANY INFORMATION PROVIDED THROUGH THE SERVICES.
28. Disclosure to Law Enforcement
Hostalika may disclose User information to law enforcement agencies in response to any lawful request or investigation without prior notice to the User. Hostalika cooperates fully with law enforcement agencies. Such disclosure may also be made pursuant to our Privacy Policy.
29. International Users
Hostalika welcomes customers from around the world, including the Middle East and North Africa (MENA) region. International users should be aware of the following:
All fees and payments are denominated in United States Dollars (USD) unless otherwise stated.
Payments in foreign currencies are subject to exchange rate fluctuations. All refunds are processed in USD at the exchange rate prevailing on the date of the refund.
You are solely responsible for compliance with all laws and regulations in your jurisdiction governing the use of hosting services.
International bank transfers may take additional processing time. We recommend initiating payment well in advance of the invoice due date.
30. Independent Contractor
Hostalika and User are independent contractors. Nothing in this Agreement creates any relationship of principal and agent, partnership, or joint venture between the parties. Neither party has the authority to make contracts or enter into agreements in the name of the other party.
31. Entire Agreement and Severability
This Agreement, including all documents incorporated herein by reference, constitutes the entire agreement between the parties with respect to its subject matter and supersedes all prior discussions, negotiations, and agreements. If any provision or portion of this Agreement is found to be illegal, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
32. Changes to the Agreement
Hostalika may modify, add, or remove provisions of this Agreement at any time. For significant changes, we will post a notice on the Hostalika website for at least thirty (30) days after the change is posted. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the updated Agreement.
33. Assignment
You may not assign or transfer this Agreement or any of your rights or obligations hereunder without the prior written consent of Hostalika. Any attempted assignment in violation of this provision is null and void. Hostalika may assign its rights and obligations under this Agreement and may engage subcontractors or agents without requiring your consent.
34. Force Majeure
Neither party shall be liable for any default or delay in performance of its obligations (other than payment obligations) caused directly or indirectly by forces beyond its reasonable control, including without limitation fire, flood, acts of God, labor disputes, accidents, acts of war or terrorism, interruptions of transportation or communications, supply shortages, or failure of any third party to fulfill any commitment.
35. Electronic Notices
You consent to receive all communications from Hostalika in electronic form, including via email and notices posted on the platform. You agree that all terms, conditions, notices, and disclosures provided electronically satisfy any legal requirement that such communications be in writing.
36. California Users
